MCP API Terms of Use

These MCP API Terms of Use (“MCP Terms”) supplement and are incorporated into the LaborIQ Terms of Service. In the event of a conflict, these MCP Terms govern with respect to MCP API access. By accessing or using the MCP API, you agree to both.

1. What This Covers

These terms govern your access to and use of the LaborIQ Model Context Protocol (MCP) API (“MCP API”), which enables AI assistants and large language model (LLM) applications to query LaborIQ’s labor market data programmatically. This includes access via the free tier (an API key issued by email, with usage limits and an expiry) and the Pro tier (the API key from your LaborIQ account).

2. Acceptance

By connecting to or querying the MCP API — whether directly, through an AI assistant, or through any third-party tool — you agree to these MCP Terms on behalf of yourself and, if applicable, your organization. If you do not agree, you must immediately cease all access to the MCP API.

3. Permitted Use

You may use the MCP API solely to:

  • Query salary and labor market data for lawful informational and business purposes
  • Integrate LaborIQ data into AI assistant workflows within your organization
  • Build internal tools or AI-augmented HR, recruiting, or compensation workflows

All use must comply with applicable law, including employment, privacy, and anti-discrimination laws.

4. Prohibited Uses

You may not:

  • Resell, sublicense, or redistribute MCP API data or outputs to third parties
  • Use automated systems to bulk-extract, scrape, or mirror LaborIQ data beyond normal API query volumes
  • Use salary data as the sole or primary basis for automated employment, hiring, or compensation decisions without meaningful human review
  • Attempt to reverse-engineer, bypass, or circumvent access controls, rate limits, or authentication mechanisms
  • Use the MCP API in any application that facilitates unlawful discrimination in hiring or compensation
  • Misrepresent LaborIQ data as your own proprietary data or remove attribution

5. Data Accuracy and Limitations

LaborIQ provides salary and labor market data from third-party sources it believes to be reliable. However:

  • All data is provided for informational purposes only and does not constitute professional compensation advice, legal advice, or a guarantee of prevailing market rates
  • LaborIQ makes no warranty, express or implied, as to the accuracy, completeness, or fitness for a particular purpose of any data returned through the MCP API
  • Actual compensation may vary based on factors including individual qualifications, employer practices, and local market conditions not captured in aggregate data

You are solely responsible for how you interpret, apply, and act upon data received through the MCP API.

6. AI and Automated Decision-Making

The MCP API is designed for use with AI assistants and LLM-based tools. You acknowledge and agree that:

  • AI-generated responses based on LaborIQ data may reflect the interpretation of the underlying AI model and should not be treated as authoritative compensation determinations
  • You may not rely solely on AI-generated salary outputs to set, adjust, or withhold compensation for individual employees or candidates without independent human review
  • LaborIQ is not responsible for how AI models interpret, summarize, or present data returned by the MCP API
  • Queries you submit through the MCP API may be logged for security, rate-limiting, and service quality purposes. LaborIQ does not use query content to train AI models

7. API Keys and Account Security

Every request to the MCP API carries an API key. For any key issued to you:

  • Your API key is personal and confidential. Do not share it or embed it in publicly accessible code or repositories
  • You are responsible for all activity made using your API key
  • Report suspected unauthorized use immediately to support@laboriq.co
  • LaborIQ reserves the right to revoke API keys that violate these MCP Terms without prior notice

8. Security Incident Reporting

If you discover or reasonably suspect a security vulnerability, unauthorized access, or data exposure involving the MCP API, you must:

  • Notify LaborIQ promptly at security@laboriq.co with sufficient detail to reproduce or assess the issue
  • Refrain from exploiting the vulnerability beyond what is necessary to confirm its existence
  • Not disclose the vulnerability publicly until LaborIQ has had a reasonable opportunity to investigate and remediate

LaborIQ will acknowledge receipt of security reports within 5 business days. You may not conduct active security testing against production MCP API endpoints without prior written authorization from LaborIQ.

9. Intellectual Property

All data, content, and outputs made available through the MCP API are the proprietary information of ThinkWhy dba LaborIQ or its data providers. These MCP Terms do not transfer any ownership rights to you. Attribution to LaborIQ (as provided in API responses) must be preserved in any downstream use or display of the data.

10. Limitation of Liability

To the fullest extent permitted by applicable law, LaborIQ’s liability arising out of or related to your use of the MCP API is limited to the amount specified in the LaborIQ Terms of Service. LaborIQ is not liable for any indirect, incidental, consequential, or punitive damages arising from your use of MCP API data, including any employment or compensation decisions made in reliance on such data.

11. Service Availability and Rate Limits

LaborIQ does not guarantee uninterrupted availability of the MCP API. LaborIQ may impose rate limits, throttle, suspend, or terminate access at any time, with or without notice, to protect service integrity or enforce these MCP Terms.

12. Privacy

Your use of the MCP API is also subject to the LaborIQ Privacy Policy. Query data submitted through the MCP API is processed in accordance with that policy and applicable privacy law. LaborIQ uses Amazon Web Services as its primary infrastructure provider. No personally identifiable information about job seekers or employees should be submitted as part of MCP API queries.

13. Governing Law

These MCP Terms are governed by the laws of the State of Texas. Any disputes arising under these MCP Terms are subject to mandatory binding arbitration in Dallas County, Texas, as specified in the LaborIQ Terms of Service.

14. Modifications

LaborIQ may update these MCP Terms at any time by posting a revised version at laboriq.co/mcp-terms or by notifying registered users. Continued use of the MCP API after any modification constitutes acceptance of the updated terms.
